Terms and Conditions
Version 1.0 · updated 2026-10-23
Last updated: see the version shown in your account. By applying for or using a merchant account you agree to these terms.
1. Who we are
SmartAlgoFX Pay is operated by SmartAlgoFX ("we", "us"). We provide a service that lets businesses ("Merchants") accept cryptocurrency payments from their customers ("Payers") and receive the proceeds in a merchant balance.
2. Eligibility and approval
- The service is for businesses and professionals aged 18 or over who can legally enter into contracts.
- Every application is reviewed. We may approve, reject or limit an account at our sole discretion and may ask for additional information (for example identity, business or source-of-funds details).
- You must provide accurate information and keep it up to date.
3. Prohibited activities
You may not use the service for anything illegal or for: fraud or scams; money laundering or terrorist financing; sanctioned persons or territories; illegal drugs or weapons; adult content involving minors or non-consensual content; unlicensed gambling, unlicensed financial or investment services, ponzi or pyramid schemes; stolen data; or any activity that breaches the law that applies to you or to us. We may suspend accounts and freeze balances that we reasonably suspect breach this section.
4. How payments work
- A Merchant creates an invoice through our API or dashboard. The Payer sends the exact cryptocurrency amount, on the correct network, to the address shown on the payment page.
- Blockchain transactions are irreversible. We treat a payment as confirmed only after it is final on the blockchain and matches the invoice.
- Payments of a wrong amount, wrong token, wrong network, or after the invoice expired may not be credited automatically. Such payments are handled manually on a best-effort basis and may be subject to fees; funds sent to a wrong network or token may be unrecoverable.
- Overpayments are not credited to the Merchant beyond the invoiced amount. Refunding a Payer is the Merchant's responsibility unless we agree otherwise.
5. Fees and commission
- We charge a commission on each confirmed payment. The percentage is agreed with each Merchant, shown in the Merchant's dashboard and stored on every invoice when it is created. A later change applies only to new invoices.
- Commission is deducted automatically from the amount credited to the Merchant balance.
- Withdrawals are subject to a minimum amount and a network fee shown before you request them.
6. Merchant balance and withdrawals
- Confirmed payments, minus commission, are credited to your balance in the coin received. Your balance is a claim against us, is not a bank deposit, does not earn interest and is not insured.
- You can request a withdrawal to a wallet address you control. We process withdrawals manually and may delay or refuse a withdrawal for security, compliance or legal reasons. You are responsible for the correctness of the address; transfers to a wrong address cannot be reversed.
- We may hold or freeze a balance where required by law, by a court or authority, or where we reasonably suspect a breach of these terms.
7. Your responsibilities
- Keep your password, two-factor codes, API secrets and webhook secrets confidential. You are responsible for activity carried out with them. Tell us immediately if you suspect a compromise.
- Verify webhook signatures and check the invoice amount, currency and status before delivering goods or services.
- Comply with all laws that apply to your business, including tax, consumer protection, sanctions and anti-money-laundering rules.
8. Availability and changes to the service
The service is provided "as is" and "as available". We do not guarantee uninterrupted operation. Blockchain networks and third-party providers can be delayed or fail, and we are not responsible for delays outside our control. We may add, change or remove supported coins, networks and features.
9. Liability
To the maximum extent permitted by law we are not liable for indirect or consequential loss, lost profit, or losses caused by blockchain events, price movements, third-party providers, or your failure to protect your credentials. Our total liability for any claim is limited to the fees we received from you in the three months before the event. Nothing limits liability that cannot be limited by law.
10. Suspension and termination
You may close your account at any time after withdrawing your balance. We may suspend or terminate an account at any time, with notice where the law requires it. Sections that by their nature should survive termination continue to apply.
11. Changes to these terms
We may update these terms. We will show the new version in the dashboard and, for material changes, notify you by email. Continuing to use the service after the effective date means you accept the update.
12. Governing law
These terms are governed by the laws of United Arab Emirates, and the courts of that place have jurisdiction, unless mandatory law says otherwise.
